The Firm obtained summary judgment for a client in federal wage and hour litigation in the SDNY. The plaintiff had alleged that he was entitled to compensation for his meal periods under the FLSA and NY Labor Law based on restrictions that his employer placed on him during his breaks. The employer moved for summary judgment and the Court granted the motion, finding that the plaintiff was not entitled to be paid for his meal periods and dismissing all claims.
